Recall that from October 1, 2018 the certificate on registration of real estate has been canceled. Registration shall be effected by entering the record in electronic form into the State Register of rights to immovable property and transactions with them.

This includes the introduction of interdepartmental co-operation arrangements initially scheduled for that date (khokimiyats, notaries, territorial divisions of the Ministry of Territorial Administration on the right of ownership and other property rights, including the occurrence, transfer, limitation or annulment of these rights) Moved to February 1, 2019. At the same time, they need to develop and launch a special information and software complex.

These aspects are reflected in the new document. The following changes have been made to the document as compared to the previous version:

Firstly, the single rules of state registration of rights to real property objects were determined. Previously, legal entities and individuals (except businesses) applied directly to the territorial branches of state-owned enterprises, and the State Property Centers of the State Land Cadastre.

Now, there are no categories of subjects: each of them can apply electronically through the State Services Center at the location of the real estate or through the YaIDXP. A pledge letter issued by the bank to a debtor (a legal entity or a natural person) is the exemption certificate of the mortgage of real estate. In this case land management and real estate cadastre should be addressed to regional branches of state-owned enterprises.

Secondly, juridical and physical persons are provided with free access to information from the State Register of Rights to Real Estate Objects. The State Registry is the official source of state property guaranteed by the state real property objects and their registered rights. It will be posted on the Internet for everyone to use it freely.

The real property and the right to it are provided in the register from the register. It can be obtained through the official website of the Committee for the Democratic Institution Building or the State Committee for Geology and Mineral Resources. Electronic or electronic versions are considered to be equivalent in the sense of legal effect;

Thirdly, information and communication exchange between the competent authorities is introduced (see above) to create favorable conditions for registration of rights of legal and natural persons for real estate objects (see above);

Fourthly, the mechanism of pre-trial settlement of disputes is introduced. For this purpose special committees will be established at the Davergeodezcadastre Committee and its territorial subdivisions. They shall examine disputes arising in the course of state registration of rights to real property objects within 10 days from the date of receipt of the application.

The conclusion of the Commission is compulsory for the person who has made a decision on registration or refusal to register, and is a ground for changing the decision he has made. Persons who have previously accepted this decision are not in the commission for impartiality.
